These Terms of Use (hereinafter referred to as the “Terms”) constitute an agreement for utilizing the information provision service for consultants (hereinafter referred to as the “Service”; if the name or content of the service is changed for any reason, the service after such change shall be included) on the website “ConsulNext.jp” (hereinafter referred to as the “Site”) operated by Mirai Works Inc. (hereinafter referred to as the “Company”). Please agree to the contents of these Terms before using the Service.
Article 1 (Applicability)
- These Terms shall apply to any and all relationships between the User and the Company regarding the use of the Service, and the User shall comply with the contents of these Terms when using the Service.
- Users may not use the Service unless they agree to these Terms.
- The User shall be deemed to have agreed to these Terms upon using the Service, regardless of the reason.
- The Company may establish various rules regarding the use of the Service by posting them on the Site, notifying the User, or by any other method deemed appropriate by the Company. Such rules, together with these Terms, shall constitute a part of this Agreement. If there is any discrepancy between the provisions of these Terms and the contents of such rules, the contents of the rules shall prevail unless otherwise specified.
Article 2 (Precautions for Use)
- The User shall use the Service of their own free will and shall assume all responsibilities arising from such use.
- The User shall use the Service upon acknowledging in advance that the use of the Service does not guarantee the realization of a career change or an employment/service contract.
- The User shall use the information obtained from each content of the Site at their own judgment and responsibility.
- While the Site may introduce links to external websites, the Company does not provide any warranty regarding the corporations, institutions, products, information, etc., at the linked destinations.
- The job opening information posted on the Service is provided under the responsibility of the information source, and the Company shall assume no responsibility whatsoever for any posted information.
- When the User applies for job openings, registers as a member, or makes inquiries via the job opening information posted on the Service, the User shall do so upon agreeing to the terms of use and privacy policy of the company providing such job opening information. Inquiries shall be made directly to the provider of the job opening information, and the Company shall assume no responsibility whatsoever for transactions or any other interactions with the company.
Article 3 (Intellectual Property Rights, etc.)
- All rights, including copyrights, patent rights, and other intellectual property rights, regarding materials and information provided by the Company in the Service, shall belong entirely to the Company or a third party designated by the Company.
- No rights, including copyrights, patent rights, or other intellectual property rights regarding the relevant content, shall be granted to the User.
- The User may not reproduce, copy, modify, or provide to a third party the materials and information provided by the Company through the Service without the prior written consent of the Company.
- In the event that a dispute or the like arises between the User and a third party in violation of the provisions of this Article, the User shall resolve the issue at their own responsibility and expense, and shall not cause any inconvenience or damage to the Company.
Article 4 (Prohibited Matters)
When using the Service, the User shall not engage in any of the actions specified in the following items.
- Acts of providing false or inaccurate information
- Acts that slander, defame, or threaten individuals or organizations, or acts likely to do so
- Acts that infringe or are likely to infringe upon the rights of others, including copyrights, trademark rights, and other intellectual property rights
- Acts of using information obtained through the Service beyond the scope of business purposes, or disclosing or providing it to a third party, regardless of the method, including reproduction, sale, or publication
- Acts of demanding money or other benefits from the Company or a third party, or causing disadvantage or damage to them, by utilizing information obtained through the Service
- Acts that impede the smooth operation of the Service, damage the credibility or honor of the Company, or acts likely to do so
- Criminal acts, acts that violate laws and regulations, acts contrary to public order and morals, or acts likely to do so
- Acts of belonging to an organization related to anti-social forces, or maintaining inappropriate relationships such as providing benefits to or utilizing anti-social forces, or acts likely to do so
- Other acts that the Company reasonably deems inappropriate
Article 5 (Suspension, Termination, etc. of the Service)
- The Company may modify or temporarily interrupt the Service without prior notice to the User.
- The Company may interrupt for a long period or terminate the provision of the entire Service.
Article 6 (Liability of the Company)
- The Company shall assume no liability whatsoever for any emotional distress or financial damage caused directly or indirectly to the User as a result of the User’s registration, application to job openings posted on the Service, or use of the Service.
- Except in cases of intentional misconduct or gross negligence by the Company, the Company shall assume no liability whatsoever if the User causes damage to a third party or if a dispute arises as a result of the User’s registration, application to job openings posted on the Service, or use of the Service.
- The equipment, communication lines, and other user environments necessary to use the Service shall be prepared by the User at their own responsibility and expense.
- The Company shall assume no liability for any damage caused to the User if the provision of the Service is hindered or becomes difficult due to force majeure, such as virus damage that cannot be prevented by reasonable anti-virus measures normally taken in information handling operations, or fires, power outages, natural disasters, etc., not attributable to the Company.
- The Company does not guarantee the accuracy of information regarding third parties, such as corporate information, corporate advertisements, job advertisements, and other information provided by third parties among the information provided to the User.
- The Company does not guarantee that the Site is free of errors or other malfunctions, that the servers, etc., do not contain viruses or other harmful elements, or that there are no defects in the infrastructure, systems, etc., for providing the Service.
Article 7 (Handling of Personal Information)
- The handling of personal information shall be separately specified in the “Handling of Personal Information.” Based on this, the Company shall be entitled to appropriately collect, use, manage, store, or provide the User’s personal information to third parties, and the User hereby agrees to this.
- In principle, the Company does not collect sensitive information specified in the following items (hereinafter referred to as “Sensitive Information”). However, if the User voluntarily provides Sensitive Information to the Company, the User shall be deemed to have consented to the Company acquiring such Sensitive Information and providing it to third parties within the scope necessary for appropriate employment placement and provision of job opening information to the User.
- Matters concerning thoughts, beliefs, or religion
- Matters concerning race, ethnicity, family origin, legal domicile (excluding information regarding the prefecture where it is located), physical/mental disabilities, criminal record, and other matters that cause social discrimination
- Matters concerning workers’ right to organize, collective bargaining, and other collective actions
- Matters concerning participation in mass demonstrations, exercise of the right to petition, and exercise of other political rights
- Matters concerning healthcare, medical treatment, or sex life
Article 8 (Disclaimer Regarding Provision to Third Parties)
The Company shall assume no responsibility whatsoever regarding the acquisition of personal information by third parties in the cases specified in the following items.
- When the User voluntarily discloses or provides personal information to specific job offerers, etc., using the Service
- When the individual happens to be identified incidentally based on the information provided by the User in the Service, such as the User’s activity status
- When the User provides personal information on an external website linked from the Service, and such information is used
Article 9 (Handling of Statistical Data, Attribute Information, etc.)
Regardless of whether it is before or after the registration or deletion of the User, the User acknowledges in advance that the Company may process, aggregate, and analyze personal information registered by the User on the Service, and the use history of the Service (including, but not limited to, page views, application history, and the process, manner, and success/failure status of operations through the Service) either by identifying or without identifying individuals, and create statistical data, attribute information, etc., formatted so that individuals cannot be identified or specified, and that the Company may utilize these without any restrictions.
Article 10 (Changes to the Service Terms of Use)
The Company may modify these Terms at any time within the scope of the purpose of the Service. In such a case, the Company shall notify the Users of the modification contents and the effective date by displaying them on the Site or by another method designated by the Company. If the User uses the Service on or after the effective date, the User shall be deemed to have agreed to the modified Terms.
Article 11 (Damages)
If the User violates these Terms or causes damage to the Company in connection with the use of the Service, the User shall compensate the Company for any and all damages, whether direct or indirect.
Article 12 (Matters for Consultation)
In the event that any doubt arises regarding the interpretation of these Terms, or for matters not stipulated in these Terms, the Company and the User shall resolve the issue through sincere consultation.
Article 13 (Governing Law and Jurisdiction)
The Service and these Terms shall be governed by and construed in accordance with the laws of Japan, and any and all disputes arising in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
